These conditions related to the procedures of goods delivery and payment, are a fundamental part of the contract between you and LML Company Srl as stated by the law (art. 50 e seguenti del D. Lgs. n 206/2005) on distance sales.
All the contracts made on www.nanarossa.com are distance contracts regulated in Capo I, Title III of Legislative Decree of the 6th September 2005, n- 206 (“Consumer Code”).
We encourage you to read carefully the contractual terms every time you decide to purchase on www.nanarossa.com and to keep a copy of it.
The products and the goods' prices that you will find on www.nanarossa.com are part of an offer described under the General conditions and on the site www.nanarossa.com. The terms of these offers are to be applied only on the purchases made on www.nanarossa.com. The purchase agreement done on the website are closed with LML Company Srl.
Price lists specified by the supplier to the public and viewable on the site www.nanarossa.com, may be subject to discounts and promotions that will be duly indicated on the product page with "price crossed out" and the percentage discount applied.
Each price and each cost of shipping include VAT (22%) and are highlighted during the last phase of the purchase. The price applied to the client's order are the ones present on the site at the moment of the purchase.
To purchase on www.nanarossa.com one must be AT LEAST 18 YEARS OLD. Once the order is complete one will receive an e-mail with all the order details, the date, the address for the delivery and for the invoice (if requested), the order number and all the conditions regarding your order. We invite you to print or to keep the e-mail. In case you do not receive the email we advise you to contact us.
If the product results to be out of stock on the website the purchase cannot be carried out, if instead it happens not to be available after you have completed your order, LML Company will provide you a full refund.

The shipping costs are payed by the customer if it is not differently specified on the website. The delivery will be done by specialized carriers. At the moment of the delivery you will have to check that the package number corresponds to the transport number and that the packaging of the product (including the materials used to close the pack) are not damaged, wet, or in any way altered. In case one of the conditions listed before occurs, the customer must immediately notify the damage by placing on the delivery document of the carrier a Written Subject to Control. We remind you that once you will have signed the delivery document you cannot claim that the packaging is damaged.
In the case that the delivery cannot be carried out repeatedly to the address given when the order was done, it will be immediately cancelled and LML Company will provide a refund of the good only. Shipping costs will not be refunded.
Shipments are carried out by a courier within 4 working days after receipt of payment. The delivery will take place within 2/3 working days after receipt of payment.
We remind you that deliveries will not be made to Hotels, Post Offices boxes or Post Offices.
As stated from D.Lgs no. 21 of February 2014, you have the right of withdrawal from the contract within 30 working days, without giving any reason. The withdrawal period will expire after 30 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires physical possession of the goods. You can also fill in and send by e-mail the withdrawal online form or any other statement through our website www.nanarossa.com
If you use this option, we will communicate to you an acknowledgement of receipt of such a cancellation on a durable medium (e.g. by e-mail) without delay.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall refund to you all payments received from you, including the delivery costs (with the exception of the additional costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 30 days from the day on which we are informed about your decision to withdraw from this contract.
We will carry out such refund by using the same payment method you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such refund. We may withhold the refund until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to us at the following address:

without undue delay and in any event not later than 30 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the expiration of the 30-day period.
The costs of the return of the products are at your own expense.
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning the goods.
We remind you that you can exercise your right on the entire order or only on part of it, if the product is not damaged, in its original packaging and complete in all parts.
If one correctly uses its right to withdraw LML Company, within 30 days from when the communication of the withdraw is received, will refund one completely the price of the item with the same payment option chosen at the moment of the purchase, but not the cost of the shipping.
FOR WHAT CONCERNS CLOTHING: the good besides having to be returned in its original pack, must not have been worn and has to be folded in it’s original plastic bag.
The right to withdraw DOES NOT apply to personalized products made exclusively for the customer.
In case of a faulty product the refund will be completely payed by us. In order to ask for this one you must contact the Customer Service which will arrange for a Courier to pick up the product.
LML Company provides a service for the collection of the product that wants to be returned at the cost of € 7. This cost will be subtracted by the total amount of the refund. If you want to use this service one must contact the Customer Service.
Privacy and Security
The holder of personal data is LML Company Srl, Corso Matteotti 32/A, 10121 Torino, Italia.
The Legislative Decree 196/2003, (the Italian ‘Data Protection Act’) guarantees that the personal data will be used respecting the rights, the fundamental freedoms and the dignity of the physical person, with particular reference to the discretion of the personal identity. We will use one’s data respecting the rights of the people involved.
Furthermore we inform you that, pursuant to the art.13 of the above mentioned Legislative Decree, the use of personal data (which will occur using information technology) has the purpose of proceeding with the execution of the contract. When necessary we will provide one’s data to the business responsible for the shipping and to all other businesses involved in the process of sale and shipping of the product. The provision of data is necessary in order to carry out a sales agreement.
We inform you that if you will give your permission, your data could be used in order to send you information regarding the world of Nanarossa: events, promotions and the launch of new products. One’s data con only be communicated to businesses connected to LML Company Srl with the same purposes as above. The adhesion to this is optional.
Legislative Decree no.196/2003, Section 7 - Right to access personal data and other rights
1. The interested party shall have the right to obtain confirmation as to whether or not personal data concerning him exist, regardless of their being already recorded, and communication of such data in intelligible form.
2. The interested party shall have the right to be informed:
a) of the source of the personal data;
b) of the purposes and methods of the processing;
c) of the logic applied to the processing, if the latter is carried out with the help of electronic means;
d) of the identification data concerning data controller, data processors and the representative designated as per Section 5, article 2;
e) of the entities or categories of entity to whom or which the personal data may be communicated and who or which may get to know said data in their capacity as designated representative(s) in the State’s territory, data processor(s) or person(s) in charge of the processing.
3. A data subject shall have the right to obtain:
a) updating, rectification or, where interested therein, integration of the data;

Your contract with LML Company is intended to be concluded in Italy and regulated by the Italian Law. For civil and penal disagreement from the conclusion of the contract of distance sale, the local jurisdiction is exclusively limited to Court of Turin (D.Lgs. 206/2005 art. 66 bis).
According to the article 49, paragraph 1, letter V of the Legislative Decree 206 of 6 September 2005 (Consumer Code), the customer may invoke the Joint Conciliation Procedure.
The procedure can be initiated if, after having complained to the company, within 30 days, the consumer hasn't received an answer or if he thinks the answer has not been satisfactory.
The customer who decides to use the Joint Conciliation Procedure has the obligation to forward the application to the email address email@example.com or to the fax number 02/87181126.
